Vacation days increased for workers in Mexico

The reform to articles 76 and 78 of the Federal Labour Law was published last December 27th, 2022, increasing the minimum vacation benefit for employees based on their seniority.

The reform is to be generally applied starting on January 1st 2023 for all current employees and new hires. Below is a comparison chart:

Starting on the sixth year, the vacation period increases by two days for every five years of service.

Employers can grant more vacation days than the mandatory minimum. If they are currently granting more days than required, they have to maintain that number.

Other repercussions of the reform are various increases:

  • In the payment of the holiday premium
  • In social security contributions
  • Payroll tax
  • In compensation payments

The Law shall apply, even if individual and/or collective contracts are not updated.
